Sportsman’s Guide’s National Hammock Day Instagram Giveaway (the “Giveaway”), begins at 09:00 a.m. ET on Friday, July 22nd 2016 and ends at 11:59 p.m. ET Sunday, July 24th 2016 (“Contest Period”). Winner will be posted on the Sportsman’s Guide Page on Instagram on or about July 25th, 2016.
Contest Brief Overview:
Like and tag an Instagram friend under The Sportsman’s Guide’s promotional photo posted on The Sportsman’s Guide© Instagram page (www.Instagram.com/sportsmansguide) on Friday, July 22nd as directed in the post You may only enter one (1) time during the Contest Period.
ELIGIBILITY: Subject to the terms and conditions described herein, any legal resident or citizen of the fifty (50) United States or District of Columbia who as of the date of his/her submission (i) resides in the one of the 50 United States or the District of Columbia and (ii) is 18 years of age or older, or the age of majority in her or her state of residence at the time of entry, may participate in the Contest. Individuals who are employees, officers or directors of The Sportsman’s Guide, Inc. (“Sponsor”), PM Digital (“Contest Administrator”), and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, and the immediate family members (spouses, domestic partners and parents, children and siblings and their spouses or domestic partners, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible to win. All applicable federal, state, and local rules apply.
Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a Prize is contingent upon not only proof of eligibility but upon fulfilling all requirements of the Official Rules.
TO ENTER: During the Giveaway Period, Users must like and tag an Instagram friend under The Sportsman’s Guide’s promotional photo posted on The Sportsman’s Guide© Instagram page on Friday, July 22nd 2016. The entry period is Friday, July 22nd 2016 through Sunday, July 24th 2016. You must have or create a Instagram account to participate. Each participant may make a maximum of one (1) entry during the Giveaway Period. Multiple entries are not permitted. Any attempt by any entrant to make more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified at The Sportsman’s Guide’s sole discretion. All entries must be received by The Sportsman’s Guide© during the Giveaway Period or they will be void
Any attempt by any entrant to obtain more than one entry by using multiple/different email addresses, identities or registration information, or by any other methods, will automatically void all of that entrant’s attempted or actual entries and the entrant may be disqualified from participation. Use of any automated system to enter is prohibited and will disqualify the entrant and all of their attempted or actual entries. Any decision to void an entry or disqualify and entrant is made at Sponsor’s sole discretion.
WINNER SELECTION:
Throughout the Contest Period, 1 winner will be randomly selected from all eligible entries to receive a Guide Gear Portable Folding Hammock. Prize award is subject to verification of eligibility and compliance with these Official Rules. Prize ARV is $42.99.
Total ARV of all prizes: $42.99. Prizes and the redemption thereof are subject to terms and conditions specified by Sponsor. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Prizes cannot be transferred, substituted or redeemed for cash, or used in conjunction with any other competition or offer. Sponsor reserves the right, in its sole discretion, to substitute and or modify a prize with a prize of comparable or greater retail value. All prize details are at Sponsor’s sole discretion. Prize winner is solely responsible for all applicable taxes and fees associated with Prize receipt and use. U.S. winners may be issued an IRS 1099 form for Prizes with an ARV over $600. No more than the stated number of Prizes will be awarded.
WINNER NOTIFICATION: The potential winner will be notified on or about the applicable drawing date through Instagram. To claim their prize, the potential winner may be required to confirm their eligibility for this Giveaway, acknowledge their agreement with these Official Rules, and/or provide personal information to enable Sponsor to fulfill its tax reporting obligations within the time periods specified in the prize notification. If Contest Administrator, using commercially reasonable efforts, is unable to contact the potential winner within five (5) business days from the first contact attempt, a prize or prize notification is returned as undeliverable or if the potential winner has not, or does not, comply with these Official Rules, then such potential winner shall be automatically and without further notice disqualified and, at Sponsor’s discretion, an alternate winner may be selected.
GRANT OF PUBLICITY: By participating in this Contest, you agree to permit Sponsor and its designees to use your name, city and state address and image or profile photo for advertising, publicity and promotional purposes, in any manner, in any and all media, now or hereafter developed, including but not limited to within Sponsor’s website and on Sponsor’s social media pages, in perpetuity, without compensation (unless prohibited by law) or permission from, or notification to, you, and further agree to execute any specific consent needed or requested by Sponsor or its designees in furtherance of such use.
GENERAL CONDITIONS: By participating in this Contest, you agree: [a] to these Official Rules and decisions of Sponsor and Contest Administrator, which shall be final and binding in all respects relating to the Contest; and [b] to release, waive, discharge, indemnify, defend and hold harmless Sponsor, Contest Administrator, Instagram, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, shareholders, partnership, members, principals, employees, agents, contractors or suppliers (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind arising out of or related to their participation in the Contest or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy.
Released Parties are not responsible for and shall not be liable for: [a] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of Entries or votes; [b] failed, incomplete, garbled or delayed computer transmissions; late, lost, inaccurate, delayed, stolen, garbled, misdirected or incomplete entries or votes or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes; or any condition caused by events that may cause the Contest to be disrupted or corrupted. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Contest. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest or any portion thereof should viruses, bugs or other causes corrupt the administration, security or proper play of the Contest, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion and, if terminated, to award the prizes from all non-suspect, eligible entries received prior to such action or as otherwise deemed fair and appropriate by Sponsor.
CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Use of any device to automate entry or to subvert the entry process or to impair the integrity of the entry process is prohibited and all such entries will be void. Contest Administrator reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules.
GOVERNING LAW: The Contest and these Official Rules shall be construed in accordance with Minnesota state law.
